WORKPLACE SEXXUAL HARASSMENT

Often sexual harassment is called workplace sexual harassment. Workplace sexual harassment is a form of sex descrimination and violates Title VII of the Civile Rights Acto of 1964 and California Fair Employment and Housing Act.

WHAT IS WORKPLACE SEXUAL HARASSMENT?

Unwelcome sexual advances or other visual, verbal, or physical conduct of a sexual nature and actions that create a hostile work environment.  This must be based upon the persons sex.  This may be based upon an employee's actual or percieved sex or gender-identity, actual or percieved sexual orientation, and/ or pregnancy childbirth or related medical conditions.  

WHAT CAN YOU DO IF YOU ARE A VICTIM?

If you are experiencing harassment in the workplace kjnow that you have options support when you decide to come forward.  

  If your company has a sexual harassment policy, read it and take action accordingly.  put complaints in writing and keep records of each incident the date and time that it occurred noting the time date and any people involved.  

   Inform your employer about the harassment pursuant to the options in and requirements set out in the sexual harasssment policy if such a policy exists.  In fome cases failure to report the conduct in any way may impact your ability to further pursue remedies against your employer.  Nevertheless coworkers and supervisors remain personally liable for there acts of sexual harassment.  

   File a complaint with the local or state or federal agency.  You dont need a lawyer to take this step.

The Calfiornia Department of Fair Employment and Housing is the state agency charged with protecting Californias from unlawful discrimination in employment.  If there has been a violation of civil rights laws DFEH can pursue damages on your behalf.  You may file a complaint with DFEH online, by mail, or over the phone. 

The Federal Equel Oppurtunity Commission has there own federal enforces federal anti discrimination There website has information on filing complaints.  

WHAT HAPPENS AFTER THE COMPLAINT?

After your complaint is evaluated your case may be accepted fo investigation.  The other party is then required to respond to your complaint, and DFEH or EEOC will review the response with you.  If the response is unsatisfactory and a violation of federal or California law occurred,, the case will be forwarded to legal divisiion for mediation and a possible lawsuit.  

The process can a long and seemingly protracted affair.  However, we have helped people through this long and difficult process to get the compensation they deserver and to help them make the best of there lives.
